Germany's Online Gambling Landscape: A General Overview
The State Treaty on Gambling in Germany reads like two different governments argued about the same paragraph for ten years and neither one won.
Germany regulates gambling at the state level. Each of the sixteen federal states (Lander) has its own gaming authority. This creates a situation where what is legal in Bavaria might be illegal in Hesse, and what is illegal in Hesse might be legal in Schleswig-Holstein. It sounds like chaos. It is chaos, but organized chaos.
In two thousand and twelve, the Lander agreed on a uniform State Treaty on Gambling. The treaty was supposed to create a national framework. Instead, it created a framework that different states interpreted differently. Some states opened online gambling licenses. Other states restricted them. By two thousand and twenty-one, most states had agreed to a common set of rules, but the journey there was procedurally ugly.
Online slots are restricted. The most restrictive. A player in Germany cannot legally access slots from most international operators because the operators are not licensed by German authorities. A player cannot legally gamble at DraftKings for slots (in the US or anywhere else) if they are in Germany. The law is specific: interactive games of chance are regulated by the state.
Online sports betting is permitted through licensed operators. Bet365, William Hill, Betfair, many international operators have obtained German licenses. The licensing process involves background checks, financial audits, and proof of responsible gambling safeguards. The operators pay licensing fees and a gambling tax. In exchange, they can operate legally.
The Practical Landscape for Players
Poker is unregulated. Online poker occupies a gray area where neither explicitly legal nor explicitly illegal applies. PokerStars has a German market but does not have a German license. The company operates in a regulatory gray zone that has persisted for years. The government has not prosecuted the company or its players. This is a form of tacit acceptance. It is not legal. It is tolerated.
Bingo and lotteries are regulated and licensed. Online bingo is rare in Germany. Lottery play online is limited. The German government has monopolies on certain lottery products and restricts competition to protect state revenue.
Live dealer games are legally available through licensed operators. These are offered by operators who are licensed for sports betting and have extended their offerings to live casino games. Pragmatic Play and Evolution Gaming both have contracts with licensed German operators.
The financial piece is important. Germany imposes a gambling tax on operators. The tax rate varies by product. Sports betting is taxed at five percent. The operators pass this cost to players through worse odds or higher commissions. A player betting on a German-licensed sportsbook will see different odds than a player betting at an international site because the German operators have factored in the tax.
The responsible gambling requirements are strict. German operators must set deposit limits, betting limits, and session time limits at the request of players. Players can self-exclude for a defined period. The operators are required to screen for problem gambling patterns and reach out if play looks dangerous. These requirements increase operational cost. They also reduce the potential for player harm.
The enforcement mechanism is reactive. Players cannot bet at unlicensed operators without legal risk, though prosecution is rare. Operators face serious penalties for unlicensed activity. This creates a system where the industry is incentivized to obtain licenses rather than operate in the gray market. The gray markets that remain (poker, some international slots) exist because enforcement would be costly and the government has implicitly decided they are low-priority targets.
